TERMS AND CONDITIONS

 

ON GENERAL CONDITIONS OF CONTRACTS FOR PASSENGER TRANSPORT SERVICES OF MAHART PASSNAVE PASSENGER SHIPPING LTD.

 

ON INTERNATIONAL AND DOMESTIC WINGSHIPS, INTERNATIONAL AND DOMESTIC REGULAR AND SPECIAL VESSELS

 

1) Scope of the Rules

 

The MAHART PassNave Passenger Shipping Limited Liability Company (hereinafter referred to as PassNave Ltd, 1056 Budapest, Belgrade quay, International Ferry Terminal, company registration number: 01-09-268781) and all the partners (individual and group passengers, charter passengers, hereinafter referred to collectively as "Passenger") contracting with it for the carriage of passengers are subject to the provisions of these Rules, unless otherwise agreed between PassNave Ltd. and the Passenger in the contract governing the legal relationship. Passenger transport by PassNave Kft. by boat is subject to the provisions of Act V of 2013 on the Civil Code ("Civil Code"), Act XLII of 2000 on water transport, Act CLV of 1997 on consumer protection ("Act CLV"), Act No. 261/2008 (XI.3. ) ("VSZF") and the provisions of these Terms and Conditions shall apply, with the proviso that PassNave Ltd. does not provide public passenger transport.

 

2) Establishment of legal relationship

 

A passenger transport contract and a legal relationship for the carriage of passengers on the basis thereof shall be established when the passenger

 

has purchased a ticket (either in person, from a ticket machine, online or by bank transfer), or

the passenger has placed a written order for carriage and confirmation of acceptance of the order has been received by the customer.

If the passenger does not act in person, but a third party orders the passenger transport or other related services on his/her behalf, PassNave Kft. does not examine whether the third party legally represents the passenger(s). Once the order is placed, the third party becomes a contractual partner of PassNave Kft. in accordance with the provisions of the Civil Code. 6:136 of the Civil Code.

 

In the case of a person travelling without a ticket, the legal relationship for the carriage of passengers is established between PassNave Kft. and the person boarding the vessel at the moment of embarkation, on the basis of an implied obligation. 

 

3.) Obligations of PassNave Ltd.

 

PassNave Kft. is obliged to transport the holder of a valid ticket at the time and on the route indicated on the ticket if  the carriage of passengers is not prohibited by law or official regulations; the carriage of passengers is possible with the vessel available;

the carriage of passengers is not prevented by circumstances for which the passenger is responsible or which cannot be avoided by PassNave Kft. or the remedying of which is not dependent on it (force majeure).

PassNave Kft. will inform passengers of any obstacles or restrictions imposed by the authorities at the boat terminals, on its website, on its community page, and, where appropriate, by means of the press or radio, and will inform them directly in the event of individual contact details such as mobile phone numbers or e-mail. After publication of this information, it may cancel the service but shall refund the fare paid by the passenger.

 

In the case of domestic scheduled services, if the vessel is unable to start and/or continue its journey to the destination due to a travel obstacle and another vessel is unable to fulfil the transport obligation, the passenger may claim reimbursement of the fare for the unused part of the journey or return to the departure station and reimbursement of the full fare paid, unless the travel obstacle is caused by an unavoidable cause beyond the control of PassNave Ltd (force majeure).

 

In the case of using substitute means of transport, PassNave Kft. will not charge any additional fare, nor will it refund the fare.

 

Cases of force majeure include in particular:

 

  • process lock,
  • accident to another vessel,
  • collision with another vessel due to the fault of the vessel,
  • action by the authorities,
  • border blockade,
  • bomb or ammunition disposal,
  • extreme weather,
  • strike,
  • low water levels or flooding
  • dangerous floods,
  • harbour lock,
  • quarantine, epidemic,
  • other obstruction due to passenger interference,
  • criminal offence,
  • terrorist attack,
  • sickness of ship's personnel,
  • sudden illness of a passenger,
  • military operations, exercises,
  • war, military operations,
  • mine threat,
  • bridge or hydraulic engineering works,
  • failure of a canal or lifting device or lock,
  • leakage of water into the hull due to external circumstances,
  • fire,
  • other external cause beyond control.

The refund of the fare is always made at the point of sale where the passenger originally purchased the ticket (in the case of a ticket purchased from a reseller, at the reseller's point of sale).

 

No further claims against PassNave Ltd. may be made for travel disruption beyond those set out in the previous paragraphs.

 

4) Passenger's obligations

 

Passengers and their companions may only enter the area of the terminal (port) which has been opened to them; no person or person who is excluded from the carriage of passengers may enter the terminal (port) or bring into the terminal (port) any objects excluded from the carriage of passengers.

 

Passengers shall only enter the area of the ship to which they are admitted. Unaccompanied persons without a ticket, with the exception of persons accompanying sick or disabled persons, are not allowed on board. It is prohibited to engage in any activity in the boat station (port) or on board the boat that is disruptive to other passengers or to the work of the boat station (port) or its staff, or to smoke outside the designated area. Smoking is prohibited in the enclosed passenger compartment of a winged vessel and in other enclosed areas of the vessel (e.g. toilets).

 

The passenger is obliged to keep the ticket for the entire duration of the journey and to show it to the PassNave Ltd. ticket inspectors, together with the ticket card entitling the passenger to a discounted ticket.

 

It is forbidden to contaminate, pollute or damage the boat station (port), the boat and its equipment. Any person who contaminates, pollutes or damages the terminal (port) or the vessel or its equipment shall be liable to pay the costs of cleaning, disinfecting and disinfecting the vessel and to pay compensation for the damage caused.

Once on board, passengers must comply with all law and order and safety instructions given by the ship's captain.

 

PassNave Ltd. is only obliged to fulfil its obligation to carry passengers on the basis of an order if the passenger presents the required entry and exit documents and a valid ticket.

 

PassNave Kft. shall not be liable for any damages resulting from the failure to comply with or the non-fulfilment of any of the above conditions.

 

In the event of a waterborne accident or incident, the passenger must follow the instructions of the ship's crew.

 

The passenger is obliged to comply with the laws in force at the time of travel and the laws of the host country. Any costs and damages resulting from failure to comply with these rules shall be borne by the passenger.

 

If the passenger fails to comply with his/her obligation to appear and deal with the passenger within the time limit, PassNave Kft. shall only be obliged to carry passengers if this does not jeopardise PassNave Kft.'s obligations towards other passengers, e.g. the scheduled departure of the vessel.

 

Passengers may occupy their seats in the order in which they board the vessel, except for international hydrofoil programmes.

 

5.) Travel restrictions, exclusion from travel

 

You may not travel on the vessel or may be excluded from the trip:

 

persons who are drunk or intoxicated;

who behaves in a scandalous manner or otherwise causes disturbance to other passengers;

who is contagiously ill;

who, by his or her conduct, damages or endangers the safety of transport, his or her own health or that of his or her fellow passengers, or the integrity of the craft or its equipment;

who fails to comply with other provisions relating to the conduct of passengers;

travels with an invalid ticket or without a ticket and fails to change tickets at the time of inspection; fails to present his ticket or concessionary card when requested to do so;

who, with his or her clothing, luggage or in any other way, may soil the vehicle, the clothing of his or her fellow passengers or the luggage of passengers;

who carries on board the craft any article which cannot be carried as hand luggage.

The skipper of the vessel is entitled to disembark the passenger at the nearest port after the start of the voyage if the above reasons apply.

 

Patients who are unable to help themselves and children under 14 years of age may only travel on board the vessel if accompanied. Unaccompanied boarding shall be deemed to be a declaration that the passenger is over 14 years of age.

 

PassNave Kft. will transport the passenger who falls ill or has an accident during the journey to the nearest boat station (port) where the patient can receive the necessary medical care.

 

In case of suspected infectious diseases, PassNave Kft. will separate the passenger from other passengers as far as possible.

 

Passengers disembarked from the vessel due to misconduct for which they are responsible may not claim any refund of the fare or other charges paid, such as the cost of transporting bicycles, and may only request the return of their checked baggage to the original destination if it is not possible to return it during the vessel's scheduled stay at the port of embarkation.

 

 PassNave Ltd. may refuse to carry passengers if the number of passengers on board the vessel has reached the authorised number of passengers.

 

6.) Timetable, journey times

 

The vessels of PassNave Ltd. operate regular services according to the published timetable (scheduled service).

The shortest travel time between the stations on the route is determined by PassNave Ltd. PassNave Kft. is only liable for damages resulting from possible delays of scheduled services if the delay is due to the fault of PassNave Kft.

 

7) Fares, baggage fees

 

The passenger tariffs are those published by PassNave Kft. in accordance with the provisions of the law. Port charges are included in the official tariffs published by PassNave Ltd. and its partner companies (the operators of the various ports).

 

The fare includes the following services:

the fare for the section indicated on the ticket,

all port taxes for the section indicated on the ticket,

passenger accident insurance from the time of embarkation to the time of disembarkation,

on domestic wingship and scheduled services: 1 piece of hand luggage weighing up to 12 kg per person for the relevant section.

 

8.) Reservations (except for international programme hydrofoil flights)

 

Tickets can be purchased online, from a ticket machine, by bank transfer in advance or in person at designated domestic and international ticket offices, against cash or credit card payment.

 

Advance reservations can be made in person, by e-mail or by letter for some flights. The person making the reservation must provide the exact date and time of the journey, the names of the passengers and a contact telephone number and e-mail address where passengers can be contacted immediately before the journey if necessary. In the case of advance booking of an international flight, the passenger's nationality must also be provided.

 

Once the above information has been received, PassNave Ltd will confirm the booking in writing within 2 working days. In the absence of confirmation, no contract will be concluded between the parties.

 

Individual passengers

 

For all flights, the reservation is final only upon payment,

 

Within 48 hours of booking, but no later than 12.00 noon on the last working day before the date of travel, the passenger will receive a group ticket by e-mail, which will entitle him/her to board the vessel. If the bank transfer is not made by the due date, the reservation will be automatically cancelled and PassNave Kft. is not obliged to inform the passenger of this fact. PassNave Ltd. is entitled to sell reserved but unpaid seats to other parties.

 

Boarding for domestic scheduled flights is possible no later than 20 minutes before departure.

 

The ticket may be changed to another date, subject to availability, until 16:00 on the working day prior to departure, in accordance with the current opening hours as indicated on the website. Requests for changes must be made in writing to ertekesites@mahartpassnave.hu. One modification is free of charge, for each additional modification a fee of 1 000 HUF/modification/person will be charged, payable the day before departure.

 

A 5% discount is automatically calculated in the booking system for tickets for scheduled flights on the wingship booked in the online shop.

 

The booking conditions under this point do not apply to resellers who have a contractual relationship with PassNave Ltd.

 

9) Travel discounts for certain scheduled flights

 

Discounts are available for children (2-12 years old) and on flights within the framework of periodic promotions announced by the company, the rates of which are set out in the official tariffs issued by PassNave Ltd.

 

 

Student discounts are available to holders of a valid Hungarian full-time student card or an international ISIC student card.

 

Pensioner discount is available to persons over 65 years of age with a Hungarian pensioner's identity card or ID card or from EU member states, which must be supported by an ID card or passport.

 

The current timetable shows which of the above discounts are available on which flights, as well as additional discounts.

 

A 5% discount is automatically calculated by the booking system for tickets on the wingship timetable booked in the online shop. In the event of a change of date, the discount for the new date will be applied, if it is less than the discount for the original date, the difference will be payable by the passenger.

 

For our excursion boat scheduled flights and our 1-day hydrofoil programme flights, the webshop automatically calculates a 5% discount on the ticket price.

 

10) Carriage of luggage, hand luggage

 

Each passenger may carry free of charge on all PassNave Kft. flights up to 1 piece of hand luggage (not exceeding 56x45x25 cm, which can be carried by one person and does not impede boarding and disembarking or movement within the cabin), weighing up to 12 kg, as well as a baby carriage, umbrella, walking stick, small hand-held items.

 

On scheduled flights, domestic scheduled flights and programme wingship flights only hand luggage is allowed.

 

Items that cause accidents, damage or pollution, or that are prohibited by law or regulation, may not be carried.

 

Wheelchairs and other mobility equipment for persons with reduced mobility (hereinafter referred to as 'equipment') are not subject to the provisions on maximum weight and size limits for hand luggage and on charging. Persons with reduced mobility must position themselves safely to protect the health and safety of other passengers and their own health and safety. The journey may commence when the device fits into the space provided for it on the lower deck of the vessel and the combined weight of the person with reduced mobility and his/her device does not exceed 200 kg and can be lifted into the vessel by hand.

 

It is the passenger's responsibility to keep the hand luggage on board and PassNave Ltd. is not liable for any loss, theft, theft, etc. of or damage to the hand luggage for any reason.

 

In respect of baggage, the provisions of the Conditions of Carriage shall prevail in matters not or not exhaustively regulated in these Conditions of Carriage.

 

Bicycles, bicycle-trailers, electric bicycles and tandems may be transported for a limited fee on designated flights.

 

11.) Transport of live animals

 

On designated flights, dogs may be carried on a leash and muzzle only on the open upper deck, subject to the purchase of a dog ticket.  Exceptions to this rule are guide dogs, assistance dogs for the disabled or police dogs on duty. These are carried free of charge.

 

 Other small animals up to 3 kg may be carried free of charge in a specially designed carrier. 

 

12) Cancellation conditions (withdrawal)

 

a.) For all flights of the company (except for programmed wing flights):

 

In the event of cancellation of pre-booked tickets (tickets and bicycle tickets) or reserved seats, the cancelling party shall pay the following cancellation charges (penalty):

 

in the event of cancellation within 48 hours of departure or no-show, the penalty shall be 100 % of the fare.

in the event of cancellation between 48 hours and 21 days before departure, a refund of 20 % of the ticket price, minus a handling fee;

no penalty for cancellations made more than 21 days prior to departure, the fare already paid and the advance payment will be refunded by PassNave Ltd.

Cancellations must be made in writing to ertekesites@mhrt.hu or in person at one of our ticket offices during opening hours.

 

These cancellation conditions do not apply to resellers under contract with PassNave Kft, their cancellation conditions are included in the contract of engagement.

Return tickets are not partially refundable once the journey has started, i.e. after the outward journey has been made.

Only unhandled tickets can be refunded in accordance with the cancellation conditions.

If the cancellation is made by the passenger and a cash refund is not possible at the ticket office, the passenger will be charged for the cost of the transfer.

 

After the issue of a ticket or equivalent security, the refund of the payment for the ticket is further subject to the return of the unused and undamaged ticket, the presentation of the receipt and proof of identity.

 

b.) The programme for hydrofoil flights (foreign and domestic):

 

In the event of cancellation of pre-booked tickets (tickets) or reserved seats, the cancellation fee (penalty) shall be as follows:

 

  • for cancellations within 7 days before departure or no-shows, the penalty is 100 % of the fare.
  • in the event of cancellation between 8 and 15 days before departure, a refund of 50 % of the ticket price, minus a handling charge;
  • in the event of cancellation between 16 and 29 days before departure, the ticket price shall be reimbursed minus a handling charge of 25 % of the ticket price;
  • in the event of cancellation more than 30 days before departure, no penalty, the fare already paid or the advance payment of the fare will be refunded by PassNave Kft.

 

In the case of domestic and foreign destination program cruises, these Terms and Conditions apply with the following exceptions:

 

PassNave Ltd. acts as a tour operator for other non-water passenger transport programmes.

 

PassNave Ltd. reserves the right to change hotels or programmes within the same category. For Vienna programmes, arrival, departure and programme times may change.

 

Passengers must pay for and collect the booked programme ticket in person at the designated ticket offices no later than 30 days prior to the date of travel, or make payment by other means (bank transfer or authorization to debit bank card) by this date.

 

If the number of applicants does not reach the minimum number of participants indicated in the timetable and on the website, PassNave Ltd reserves the right to cancel the programme, possibly reschedule it or refund the ticket price.

 

c.) For tickets purchased from ticket machines and via the website:

 

In the case of tickets purchased from ticket machines and via the website, the cancellation conditions indicated above, adapted to the type of flight, are supplemented by the following:

 

20% handling fee for the redemption of the ticket

the amount returned after deduction of the handling fee will not be returned to the redeeming party by means of a transfer initiated by the operator but by a credit from the operator's clearing bank

the change of the travel date of the redeemed ticket is free of charge once and must be notified in writing on the last working day prior to travel in accordance with the current opening hours. 

Additional date changes are possible for a fee of 1 000,- HUF/change/person.

in the event of changes to other parameters of the ticket (e.g. change of type of vessel or service, reduction in the number of passengers), as these are only possible if the ticket is redeemed and reissued, the redemption procedure described above will apply.

 

13.) Charter of vessels

 

When chartering a charter boat, the charter rates officially issued by PassNave Ltd. shall apply. Catering services can only be booked through PassNave Kft.

 

If the charterer of the special boat also uses other berths not operated by PassNave Kft, the relevant fees will be charged separately. PassNave Kft. will provide information on these charges at the time of ordering.

 

Standing time charges for excursion and event boats are 50 % of the hourly rate for the type of boat in question per hour (the discounted standing time may be up to twice the current sailing time). For rural trips, the charter fee includes 2 hours' waiting time at the destination, with additional waiting time at a rate of 50 % of the hourly rate for the type of vessel (except for wedding events, where the rate and the amount of the standing time will be determined on an individual basis).

 

Standing time charges for wing boats for domestic voyages: the charter fee includes 4 hours of waiting time at the destination, additional waiting time will be charged at 50 % of the hourly rate of the type of boat concerned per hour.

 

For trips of several days, whether domestic or international, the charges for waiting time and other waiting costs (crew accommodation, etc.) are always calculated individually.

 

If the customer does not use the chartered vessel within one hour after the departure time confirmed by PassNave Kft. and does not inform PassNave Kft. of the impediment, PassNave Kft. is entitled to use the chartered vessel for other purposes. In this case, payment of the rental fee is subject to the conditions of cancellation within 24 hours.

 

 

a.) Ordering charter boats:

 

Charter boats must be ordered in person or in writing (letter, e-mail) and the order must include:

 

the names of the passengers/group,

number of passengers,

(only for international flights),

type of boat,

the place of departure and arrival, en route berthing requirements,

date of travel, departure and arrival times (year, month, day, hour, minute),

other service requirements,

the customer's requirements for other services.

PassNave Ltd. shall confirm the orders in writing within 2 working days and the contract shall be concluded with the confirmed content.

 

b.) Cancellation conditions (withdrawal) of chartered vessels:

 

In the event of cancellation of a chartered vessel, the cancelling party shall pay the following listed percentages of the charter fee as a penalty:

 

100 % of the charter fee in case of cancellation within 24 hours prior to departure;

50 % of the charter fee if cancelled between 24 and 48 hours before departure;

30 % of the rental fee for cancellations between 48 hours and 21 days before departure;

cancellation more than 21 days before departure is free of charge.

The cancellation date is the date of receipt of the written cancellation by PassNave Ltd.

Cancellations and amendments may only be made by the person named on the ticket or their written agent.

 

In the event of cancellation by the customer, the cancelling party shall bear the bank charges for the return of the money.

If there is an unavoidable impediment to the departure of the special boat (force majeure), both parties are exempted from the obligation to pay compensation and cancellation fees. The charter fee paid will be fully refunded by PassNave Ltd. within 30 days.

 

c.) To report any comments (complaints) concerning the special trip:

 

Any customer complaints regarding any of the services must be submitted in writing to PassNave Ltd. by 4.00 p.m. on the day following the end of the trip. This deadline is expressly time-barred. Comments can also be made in writing to the ship's captain immediately before the start of the trip, during the trip or immediately after the trip.

 

 

14.) Hospitality, sales

 

Buffet or other catering services can only be ordered or used through PassNave Ltd.

Selling at the boat station (harbour) or on board the boat is only possible with the permission of PassNave Kft.

 

 

 

15) Advertising

 

PassNave Kft. shall have exclusive use of the exterior and interior surfaces and advertising media (also in the case of special routes) of the vessels. Any deviation from this shall be subject to a separate written agreement.

 

 

 

16) Inspection, payment of surcharges

 

The passenger must be in possession of a valid ticket or travel document (hereinafter together referred to as "ticket") at the start of the journey. The passenger is obliged to keep the valid ticket with him/her for the entire duration of the journey and to hand it over to the PassNave Kft. ticket inspector for inspection during the journey and upon disembarkation, together with the ticket entitlement document. If necessary to establish the legitimacy of the travel discount or to carry out the verification procedure, the passenger must provide proof of identity.

 

The PassNave Ltd. ticket inspector is entitled to check at any time during the journey, including embarkation and disembarkation, the eligibility of passengers to travel, the validity of tickets, the legality of the use of travel discounts and compliance with the provisions of these Rules and Regulations.

 

The PassNave Ltd. ticket inspector is entitled to obtain the data necessary for the identification of a passenger who has not paid the fare, for the purpose of verifying the identity of the passenger, for the purpose of checking the entitlement to travel on a personal basis and for the purpose of verifying the lawfulness of the use of travel discounts. The verification under this section is carried out in accordance with the terms and conditions set out in the Data Security and Privacy Policy published on the website of PassNave Ltd.

 

A passenger who

 

does not have a valid ticket,

has not purchased a ticket for the correct journey, or

makes unauthorised use of a travel discount,

 

In the case of an invalid ticket, the amount of the on-the-spot surcharge is three times the full fare per person.

 

If the ticket is for an incorrect journey, the difference must be paid, plus a surcharge of three times the difference.

 

Once the journey has started, the return ticket cannot be refunded.

 

If the passenger's point of embarkation or destination cannot be determined, he/she will be charged the fare and surcharge applicable to the entire journey from the point of embarkation to the destination or from the point of embarkation to the point of disembarkation.

 

In the event of a breach of the conditions of travel, the PassNave Ltd. ticket inspector shall immediately upon becoming aware of the breach record the circumstances of the case. The PassNave Ltd. ticket inspector is entitled to prohibit the berthing of the vessel or its passage for a short period of time in order to carry out an effective inspection.

 

Passengers who are required to pay a surcharge must provide proof of identity and address to the inspector. In the event of refusal to provide such proof, the inspector may request police action to obtain the information or exclude the passenger from the journey.

 

Payment of the fare and surcharge as stated in the report may be made in cash at the ticket offices in the ports operated by PassNave Kft. or by bank transfer to the account number of PassNave Kft. indicated in the report. In the case of bank transfer, payment is deemed to have been effected when the amount of the fare and surcharge is credited to the bank account of PassNave Kft.

 

If the obligor fails to pay the fare and the surcharge as stipulated in the protocol within 8 days from the date of travel, PassNave Kft. will request the obligor to fulfil his/her obligation by setting a new deadline. If the passenger fails to meet the obligation by the new deadline, PassNave Kft. will take legal action to recover the claim. The costs of the latter shall also be borne by the debtor.

 

In the case of a journey with an invalid ticket, the full fare plus three times the full fare as a surcharge will be payable. In the case of a ticket for an inappropriate journey or an unauthorised use of a travel discount, the difference between the full fare ticket and the ticket purchased shall be payable, plus three times the amount of the difference as a surcharge.

 

17. ) Responsibility

 

PassNave Kft. is liable for damages arising during the passenger transport relationship in accordance with the provisions of these Terms and Conditions. The provisions of the Civil Code of Civil Procedure applicable to companies shall apply. The liability of PassNave Ltd. for damages shall be limited to 150% of the fare or contractor's fee paid.

 

If the passenger transport is affected or prevented by force majeure circumstances, whether or not specified in these Terms and Conditions, PassNave Kft. shall not be liable for cancellation of the flight for such reasons, or for defective performance of the passenger transport contract, but shall refund the fare paid within 30 days.

 

PassNave Ltd. shall not be liable for fragile or perishable goods in the luggage of passengers or for damage caused by them, or for damage resulting from improper packaging.

 

 

 

18) Rules for reporting and handling complaints

 

The passenger must report any complaint or report arising from the passenger transport relationship (hereinafter referred to as "complaint") without delay, but no later than 48 hours after the circumstances giving rise to the complaint arise, in order to enable PassNave Kft. to take the necessary measures to remedy the situation and to fully clarify the facts on which the claim is based. This deadline is expressly time-barred. The passenger is liable for any damage resulting from the delay in notification.

 

Oral complaint

PassNave Kft.'s complaints office is located at 1056 Budapest, Belgrade quay, International Boat Station, Customer Service

 

Opening hours: Monday - Friday: 8-16 hours.

 

10.10.10. 10.10. 10.10. Oral complaints will be investigated immediately by Passnave Kft and rectified as necessary. If the consumer does not agree with the handling of the complaint or if it is not possible to investigate the complaint immediately, the company must immediately take a record of the complaint and its position on it and send a copy to Passnaveave.com.

 

(a) in the case of an oral complaint made in person, to the consumer on the spot,

 

(b) in the case of an oral complaint made by telephone or other electronic communications service, to the consumer at the latest at the same time as the reply on the substance.

 

 

 

PassNave Ltd. shall otherwise act in accordance with the rules applicable to written complaints.

 

Written complaint

Complaints may be submitted in writing in the following ways, accompanied by a copy of the ticket and all other supporting documents:

by writing in the buyers' book at the boat stations

filling in the report form on board the vessel

PassNave Ltd. will provide a reasoned reply to complaints made by telephone or in writing within 30 days. Verbal complaints communicated by telephone or electronic communication service must be given a unique identification number by PassNave Kft. PassNave Kft. will inform the passenger of the legal remedies available to him/her in the reply letter at the end of the complaint handling procedure, as well as the contact details of the consumer protection authority and the conciliation body.

 

If the passenger's complaint is rejected, he or she may appeal to a conciliation body. The conciliation body is an independent body attached to the county (metropolitan) chambers of commerce and industry. The conciliation body of the passenger's place of residence or stay is competent for the procedure. To initiate the conciliation body's procedure, the passenger must attempt to settle the dispute directly with the undertaking concerned. The passenger may start the procedure by submitting a written request to the chairman of the conciliation body. The conciliation body shall be competent to settle consumer disputes out of court.

19.) Customer service

 

MAHART PassNave Ltd. operates a telephone customer service, the contact details and current opening hours of which are published on its website. Outside office hours, it is possible to contact the company in writing. The company will reply to any correspondence sent within 2 working days (except in the case of complaint handling, where point 18 applies).

 

20) Subcontractor

 

PassNave Ltd. is entitled to use a subcontracted carrier. If PassNave Ltd. subcontracts the performance of the passenger transport services it undertakes to another contractor, the terms and conditions of these Terms and Conditions and the individual contract shall apply.

 

 

 

21) No Licensing

 

The rights arising from the passenger transport contract may not be assigned to a third party without prior written notice to PassNave Kft.

 

22) Statute of limitations

 

All claims against PassNave Kft arising from the passenger transport contract shall, unless a shorter period is stipulated in these Terms and Conditions, expire after 6 months at the latest.

 

 

 

23) Law and Disputes

 

Hungarian law shall apply to the settlement of any disputes.

 

For the settlement of any dispute arising out of or in connection with any agreement, contract concluded under these Terms and Conditions, or in connection with the breach, termination or validity or interpretation thereof, the parties submit to the decision of the competent court of the place where the Company is established.

 

The terms and conditions of the individual contract concluded with the customer or passenger shall prevail over these Terms and Conditions.

 

24) Publication of these Terms of Business

 

PassNave Ltd. publishes the current Terms and Conditions in full on its website (www.mahartpassnave.hu), where they can be downloaded free of charge. PassNave Ltd. shall make the Terms and Conditions available for inspection at ticket offices and boat stations during opening hours.

 

The Rules and Regulations published on the website are the text in force, as amended.

 

 

Amendments:

 

The last amendment is valid until 31 December 2023.

 

TERMS AND CONDITIONS

 

ON GENERAL CONDITIONS OF CONTRACTS FOR PASSENGER TRANSPORT SERVICES OF MAHART PASSNAVE PASSENGER SHIPPING LTD.

 

ON INTERNATIONAL AND DOMESTIC WINGSHIPS, INTERNATIONAL AND DOMESTIC REGULAR AND SPECIAL VESSELS

 

1) Scope of the Rules

 

The MAHART PassNave Passenger Shipping Limited Liability Company (hereinafter referred to as PassNave Ltd, 1056 Budapest, Belgrade quay, International Ferry Terminal, company registration number: 01-09-268781) and all the partners (individual and group passengers, charter passengers, hereinafter referred to collectively as "Passenger") contracting with it for the carriage of passengers are subject to the provisions of these Rules, unless otherwise agreed between PassNave Ltd. and the Passenger in the contract governing the legal relationship. Passenger transport by PassNave Kft. by boat is subject to the provisions of Act V of 2013 on the Civil Code ("Civil Code"), Act XLII of 2000 on water transport, Act CLV of 1997 on consumer protection ("Act CLV"), Act No. 261/2008 (XI.3. ) ("VSZF") and the provisions of these Terms and Conditions shall apply, with the proviso that PassNave Ltd. does not provide public passenger transport.

 

2) Establishment of legal relationship

 

A passenger transport contract and a legal relationship for the carriage of passengers on the basis thereof shall be established when the passenger

 

has purchased a ticket (either in person, from a ticket machine, online or by bank transfer), or

the passenger has placed a written order for carriage and confirmation of acceptance of the order has been received by the customer.

If the passenger does not act in person, but a third party orders the passenger transport or other related services on his/her behalf, PassNave Kft. does not examine whether the third party legally represents the passenger(s). Once the order is placed, the third party becomes a contractual partner of PassNave Kft. in accordance with the provisions of the Civil Code. 6:136 of the Civil Code.

 

In the case of a person travelling without a ticket, the legal relationship for the carriage of passengers is established between PassNave Kft. and the person boarding the vessel at the moment of embarkation, on the basis of an implied obligation. 

 

3.) Obligations of PassNave Ltd.

 

PassNave Kft. is obliged to transport the holder of a valid ticket at the time and on the route indicated on the ticket if

 

the carriage of passengers is not prohibited by law or official regulations;

the carriage of passengers is possible with the vessel available;

the carriage of passengers is not prevented by circumstances for which the passenger is responsible or which cannot be avoided by PassNave Kft. or the remedying of which is not dependent on it (force majeure).

PassNave Kft. will inform passengers of any obstacles or restrictions imposed by the authorities at the boat terminals, on its website, on its community page, and, where appropriate, by means of the press or radio, and will inform them directly in the event of individual contact details such as mobile phone numbers or e-mail. After publication of this information, it may cancel the service but shall refund the fare paid by the passenger.

 

In the case of domestic scheduled services, if the vessel is unable to start and/or continue its journey to the destination due to a travel obstacle and another vessel is unable to fulfil the transport obligation, the passenger may claim reimbursement of the fare for the unused part of the journey or return to the departure station and reimbursement of the full fare paid, unless the travel obstacle is caused by an unavoidable cause beyond the control of PassNave Ltd (force majeure).

 

In the case of using substitute means of transport, PassNave Kft. will not charge any additional fare, nor will it refund the fare.

 

Cases of force majeure include in particular:

 

  • process lock,
  • accident to another vessel,
  • collision with another vessel due to the fault of the vessel,
  • action by the authorities,
  • border blockade,
  • bomb or ammunition disposal,
  • extreme weather,
  • strike,
  • low water levels or flooding
  • dangerous floods,
  • harbour lock,
  • quarantine, epidemic,
  • other obstruction due to passenger interference,
  • criminal offence,
  • terrorist attack,
  • sickness of ship's personnel,
  • sudden illness of a passenger,
  • military operations, exercises,
  • war, military operations,
  • mine threat,
  • bridge or hydraulic engineering works,
  • failure of a canal or lifting device or lock,
  • leakage of water into the hull due to external circumstances,
  • fire,
  • other external cause beyond control.

The refund of the fare is always made at the point of sale where the passenger originally purchased the ticket (in the case of a ticket purchased from a reseller, at the reseller's point of sale).

 

No further claims against PassNave Ltd. may be made for travel disruption beyond those set out in the previous paragraphs.

 

4) Passenger's obligations

 

Passengers and their companions may only enter the area of the terminal (port) which has been opened to them; no person or person who is excluded from the carriage of passengers may enter the terminal (port) or bring into the terminal (port) any objects excluded from the carriage of passengers.

 

Passengers shall only enter the area of the ship to which they are admitted. Unaccompanied persons without a ticket, with the exception of persons accompanying sick or disabled persons, are not allowed on board. It is prohibited to engage in any activity in the boat station (port) or on board the boat that is disruptive to other passengers or to the work of the boat station (port) or its staff, or to smoke outside the designated area. Smoking is prohibited in the enclosed passenger compartment of a winged vessel and in other enclosed areas of the vessel (e.g. toilets).

 

The passenger is obliged to keep the ticket for the entire duration of the journey and to show it to the PassNave Ltd. ticket inspectors, together with the ticket card entitling the passenger to a discounted ticket.

 

It is forbidden to contaminate, pollute or damage the boat station (port), the boat and its equipment. Any person who contaminates, pollutes or damages the terminal (port) or the vessel or its equipment shall be liable to pay the costs of cleaning, disinfecting and disinfecting the vessel and to pay compensation for the damage caused.

  • Once on board, passengers must comply with all law and order and safety instructions given by the ship's captain.
  • PassNave Ltd. is only obliged to fulfil its obligation to carry passengers on the basis of an order if the passenger presents the required entry and exit documents and a valid ticket.
  • PassNave Kft. shall not be liable for any damages resulting from the failure to comply with or the non-fulfilment of any of the above conditions.
  • In the event of a waterborne accident or incident, the passenger must follow the instructions of the ship's crew.
  • The passenger is obliged to comply with the laws in force at the time of travel and the laws of the host country. Any costs and damages resulting from failure to comply with these rules shall be borne by the passenger.
  • If the passenger fails to comply with his/her obligation to appear and deal with the passenger within the time limit, PassNave Kft. shall only be obliged to carry passengers if this does not jeopardise PassNave Kft.'s obligations towards other passengers, e.g. the scheduled departure of the vessel.
  • Passengers may occupy their seats in the order in which they board the vessel, except for international hydrofoil programmes.

 

5.) Travel restrictions, exclusion from travel

 

You may not travel on the vessel or may be excluded from the trip:

 

  • persons who are drunk or intoxicated;
  • who behaves in a scandalous manner or otherwise causes disturbance to other passengers;
  • who is contagiously ill;
  • who, by his or her conduct, damages or endangers the safety of transport, his or her own health or that of his or her fellow passengers, or the integrity of the craft or its equipment;
  • who fails to comply with other provisions relating to the conduct of passengers;
  • travels with an invalid ticket or without a ticket and fails to change tickets at the time of inspection; fails to present his ticket or concessionary card when requested to do so;
  • who, with his or her clothing, luggage or in any other way, may soil the vehicle, the clothing of his or her fellow passengers or the luggage of passengers;
  • who carries on board the craft any article which cannot be carried as hand luggage.
  • The skipper of the vessel is entitled to disembark the passenger at the nearest port after the start of the voyage if the above reasons apply.

 

Patients who are unable to help themselves and children under 14 years of age may only travel on board the vessel if accompanied. Unaccompanied boarding shall be deemed to be a declaration that the passenger is over 14 years of age.

PassNave Kft. will transport the passenger who falls ill or has an accident during the journey to the nearest boat station (port) where the patient can receive the necessary medical care.

In case of suspected infectious diseases, PassNave Kft. will separate the passenger from other passengers as far as possible.

Passengers disembarked from the vessel due to misconduct for which they are responsible may not claim any refund of the fare or other charges paid, such as the cost of transporting bicycles, and may only request the return of their checked baggage to the original destination if it is not possible to return it during the vessel's scheduled stay at the port of embarkation.

 PassNave Ltd. may refuse to carry passengers if the number of passengers on board the vessel has reached the authorised number of passengers.

 

6.) Timetable, journey times

 

The vessels of PassNave Ltd. operate regular services according to the published timetable (scheduled service).

The shortest travel time between the stations on the route is determined by PassNave Ltd. PassNave Kft. is only liable for damages resulting from possible delays of scheduled services if the delay is due to the fault of PassNave Kft.

 

7) Fares, baggage fees

 

The passenger tariffs are those published by PassNave Kft. in accordance with the provisions of the law. Port charges are included in the official tariffs published by PassNave Ltd. and its partner companies (the operators of the various ports).

The fare includes the following services:

  • the fare for the section indicated on the ticket,
  • all port taxes for the section indicated on the ticket,
  • passenger accident insurance from the time of embarkation to the time of disembarkation,
  • on domestic wingship and scheduled services: 1 piece of hand luggage weighing up to 12 kg per person for the relevant section.

 

8.) Reservations (except for international programme hydrofoil flights)

 

Tickets can be purchased online, from a ticket machine, by bank transfer in advance or in person at designated domestic and international ticket offices, against cash or credit card payment.

Advance reservations can be made in person, by e-mail or by letter for some flights. The person making the reservation must provide the exact date and time of the journey, the names of the passengers and a contact telephone number and e-mail address where passengers can be contacted immediately before the journey if necessary. In the case of advance booking of an international flight, the passenger's nationality must also be provided.

Once the above information has been received, PassNave Ltd will confirm the booking in writing within 2 working days. In the absence of confirmation, no contract will be concluded between the parties.

 

Individual passengers

 

For all flights, the reservation is final only upon payment,

Within 48 hours of booking, but no later than 12.00 noon on the last working day before the date of travel, the passenger will receive a group ticket by e-mail, which will entitle him/her to board the vessel. If the bank transfer is not made by the due date, the reservation will be automatically cancelled and PassNave Kft. is not obliged to inform the passenger of this fact. PassNave Ltd. is entitled to sell reserved but unpaid seats to other parties.

Boarding for domestic scheduled flights is possible no later than 20 minutes before departure.

The ticket may be changed to another date, subject to availability, until 16:00 on the working day prior to departure, in accordance with the current opening hours as indicated on the website. Requests for changes must be made in writing to ertekesites@mahartpassnave.hu. One modification is free of charge, for each additional modification a fee of 1 000 HUF/modification/person will be charged, payable the day before departure.

A 5% discount is automatically calculated in the booking system for tickets for scheduled flights on the wingship booked in the online shop.

The booking conditions under this point do not apply to resellers who have a contractual relationship with PassNave Ltd.

 

9) Travel discounts for certain scheduled flights

 

Discounts are available for children (2-12 years old) and on flights within the framework of periodic promotions announced by the company, the rates of which are set out in the official tariffs issued by PassNave Ltd.

Student discounts are available to holders of a valid Hungarian full-time student card or an international ISIC student card.

Pensioner discount is available to persons over 65 years of age with a Hungarian pensioner's identity card or ID card or from EU member states, which must be supported by an ID card or passport.

The current timetable shows which of the above discounts are available on which flights, as well as additional discounts.

A 5% discount is automatically calculated by the booking system for tickets on the wingship timetable booked in the online shop. In the event of a change of date, the discount for the new date will be applied, if it is less than the discount for the original date, the difference will be payable by the passenger.

For our excursion boat scheduled flights and our 1-day hydrofoil programme flights, the webshop automatically calculates a 5% discount on the ticket price.

 

10) Carriage of luggage, hand luggage

 

Each passenger may carry free of charge on all PassNave Kft. flights up to 1 piece of hand luggage (not exceeding 56x45x25 cm, which can be carried by one person and does not impede boarding and disembarking or movement within the cabin), weighing up to 12 kg, as well as a baby carriage, umbrella, walking stick, small hand-held items.

On scheduled flights, domestic scheduled flights and programme wingship flights only hand luggage is allowed.

Items that cause accidents, damage or pollution, or that are prohibited by law or regulation, may not be carried.

Wheelchairs and other mobility equipment for persons with reduced mobility (hereinafter referred to as 'equipment') are not subject to the provisions on maximum weight and size limits for hand luggage and on charging. Persons with reduced mobility must position themselves safely to protect the health and safety of other passengers and their own health and safety. The journey may commence when the device fits into the space provided for it on the lower deck of the vessel and the combined weight of the person with reduced mobility and his/her device does not exceed 200 kg and can be lifted into the vessel by hand.

It is the passenger's responsibility to keep the hand luggage on board and PassNave Ltd. is not liable for any loss, theft, theft, etc. of or damage to the hand luggage for any reason.

In respect of baggage, the provisions of the Conditions of Carriage shall prevail in matters not or not exhaustively regulated in these Conditions of Carriage.

Bicycles, bicycle-trailers, electric bicycles and tandems may be transported for a limited fee on designated flights.

 

11.) Transport of live animals

 

On designated flights, dogs may be carried on a leash and muzzle only on the open upper deck, subject to the purchase of a dog ticket.  Exceptions to this rule are guide dogs, assistance dogs for the disabled or police dogs on duty. These are carried free of charge.

 Other small animals up to 3 kg may be carried free of charge in a specially designed carrier. 

 

12) Cancellation conditions (withdrawal)

 

a.) For all flights of the company (except for programmed wing flights):

In the event of cancellation of pre-booked tickets (tickets and bicycle tickets) or reserved seats, the cancelling party shall pay the following cancellation charges (penalty):

in the event of cancellation within 48 hours of departure or no-show, the penalty shall be 100 % of the fare.

in the event of cancellation between 48 hours and 21 days before departure, a refund of 20 % of the ticket price, minus a handling fee;

no penalty for cancellations made more than 21 days prior to departure, the fare already paid and the advance payment will be refunded by PassNave Ltd.

Cancellations must be made in writing to ertekesites@mhrt.hu or in person at one of our ticket offices during opening hours.

 

These cancellation conditions do not apply to resellers under contract with PassNave Kft, their cancellation conditions are included in the contract of engagement.

 

Return tickets are not partially refundable once the journey has started, i.e. after the outward journey has been made.

Only unhandled tickets can be refunded in accordance with the cancellation conditions.

If the cancellation is made by the passenger and a cash refund is not possible at the ticket office, the passenger will be charged for the cost of the transfer.

After the issue of a ticket or equivalent security, the refund of the payment for the ticket is further subject to the return of the unused and undamaged ticket, the presentation of the receipt and proof of identity.

 

 

b.) The programme for hydrofoil flights (foreign and domestic):

 

In the event of cancellation of pre-booked tickets (tickets) or reserved seats, the cancellation fee (penalty) shall be as follows:

 

for cancellations within 7 days before departure or no-shows, the penalty is 100 % of the fare.

in the event of cancellation between 8 and 15 days before departure, a refund of 50 % of the ticket price, minus a handling charge;

in the event of cancellation between 16 and 29 days before departure, the ticket price shall be reimbursed minus a handling charge of 25 % of the ticket price;

in the event of cancellation more than 30 days before departure, no penalty, the fare already paid or the advance payment of the fare will be refunded by PassNave Kft.

In the case of domestic and foreign destination program cruises, these Terms and Conditions apply with the following exceptions:

 

PassNave Ltd. acts as a tour operator for other non-water passenger transport programmes.

PassNave Ltd. reserves the right to change hotels or programmes within the same category. For Vienna programmes, arrival, departure and programme times may change.

Passengers must pay for and collect the booked programme ticket in person at the designated ticket offices no later than 30 days prior to the date of travel, or make payment by other means (bank transfer or authorization to debit bank card) by this date.

If the number of applicants does not reach the minimum number of participants indicated in the timetable and on the website, PassNave Ltd reserves the right to cancel the programme, possibly reschedule it or refund the ticket price.

 

c.) For tickets purchased from ticket machines and via the website:

 

In the case of tickets purchased from ticket machines and via the website, the cancellation conditions indicated above, adapted to the type of flight, are supplemented by the following:

 

20% handling fee for the redemption of the ticket

the amount returned after deduction of the handling fee will not be returned to the redeeming party by means of a transfer initiated by the operator but by a credit from the operator's clearing bank

the change of the travel date of the redeemed ticket is free of charge once and must be notified in writing on the last working day prior to travel in accordance with the current opening hours. 

Additional date changes are possible for a fee of 1 000,- HUF/change/person.

in the event of changes to other parameters of the ticket (e.g. change of type of vessel or service, reduction in the number of passengers), as these are only possible if the ticket is redeemed and reissued, the redemption procedure described above will apply.

 

13.) Charter of vessels

 

When chartering a charter boat, the charter rates officially issued by PassNave Ltd. shall apply. Catering services can only be booked through PassNave Kft.

If the charterer of the special boat also uses other berths not operated by PassNave Kft, the relevant fees will be charged separately. PassNave Kft. will provide information on these charges at the time of ordering.

Standing time charges for excursion and event boats are 50 % of the hourly rate for the type of boat in question per hour (the discounted standing time may be up to twice the current sailing time). For rural trips, the charter fee includes 2 hours' waiting time at the destination, with additional waiting time at a rate of 50 % of the hourly rate for the type of vessel (except for wedding events, where the rate and the amount of the standing time will be determined on an individual basis).

Standing time charges for wing boats for domestic voyages: the charter fee includes 4 hours of waiting time at the destination, additional waiting time will be charged at 50 % of the hourly rate of the type of boat concerned per hour.

For trips of several days, whether domestic or international, the charges for waiting time and other waiting costs (crew accommodation, etc.) are always calculated individually.

If the customer does not use the chartered vessel within one hour after the departure time confirmed by PassNave Kft. and does not inform PassNave Kft. of the impediment, PassNave Kft. is entitled to use the chartered vessel for other purposes. In this case, payment of the rental fee is subject to the conditions of cancellation within 24 hours.

 

a.) Ordering charter boats:

 

Charter boats must be ordered in person or in writing (letter, e-mail) and the order must include:

  • the names of the passengers/group,
  • number of passengers,
  • (only for international flights),
  • type of boat,
  • the place of departure and arrival, en route berthing requirements,
  • date of travel, departure and arrival times (year, month, day, hour, minute),
  • other service requirements,
  • the customer's requirements for other services.

PassNave Ltd. shall confirm the orders in writing within 2 working days and the contract shall be concluded with the confirmed content.

 

b.) Cancellation conditions (withdrawal) of chartered vessels:

 

In the event of cancellation of a chartered vessel, the cancelling party shall pay the following listed percentages of the charter fee as a penalty:

  • 100 % of the charter fee in case of cancellation within 24 hours prior to departure;
  • 50 % of the charter fee if cancelled between 24 and 48 hours before departure;
  • 30 % of the rental fee for cancellations between 48 hours and 21 days before departure;
  • cancellation more than 21 days before departure is free of charge.

 

The cancellation date is the date of receipt of the written cancellation by PassNave Ltd.

Cancellations and amendments may only be made by the person named on the ticket or their written agent.

In the event of cancellation by the customer, the cancelling party shall bear the bank charges for the return of the money.

If there is an unavoidable impediment to the departure of the special boat (force majeure), both parties are exempted from the obligation to pay compensation and cancellation fees. The charter fee paid will be fully refunded by PassNave Ltd. within 30 days.

 

c.) To report any comments (complaints) concerning the special trip:

 

Any customer complaints regarding any of the services must be submitted in writing to PassNave Ltd. by 4.00 p.m. on the day following the end of the trip. This deadline is expressly time-barred. Comments can also be made in writing to the ship's captain immediately before the start of the trip, during the trip or immediately after the trip.

 

14.) Hospitality, sales

 

Buffet or other catering services can only be ordered or used through PassNave Ltd.

Selling at the boat station (harbour) or on board the boat is only possible with the permission of PassNave Kft.

 

15) Advertising

 

PassNave Kft. shall have exclusive use of the exterior and interior surfaces and advertising media (also in the case of special routes) of the vessels. Any deviation from this shall be subject to a separate written agreement.

 

16) Inspection, payment of surcharges

 

The passenger must be in possession of a valid ticket or travel document (hereinafter together referred to as "ticket") at the start of the journey. The passenger is obliged to keep the valid ticket with him/her for the entire duration of the journey and to hand it over to the PassNave Kft. ticket inspector for inspection during the journey and upon disembarkation, together with the ticket entitlement document. If necessary to establish the legitimacy of the travel discount or to carry out the verification procedure, the passenger must provide proof of identity.

 

The PassNave Ltd. ticket inspector is entitled to check at any time during the journey, including embarkation and disembarkation, the eligibility of passengers to travel, the validity of tickets, the legality of the use of travel discounts and compliance with the provisions of these Rules and Regulations.

 

The PassNave Ltd. ticket inspector is entitled to obtain the data necessary for the identification of a passenger who has not paid the fare, for the purpose of verifying the identity of the passenger, for the purpose of checking the entitlement to travel on a personal basis and for the purpose of verifying the lawfulness of the use of travel discounts. The verification under this section is carried out in accordance with the terms and conditions set out in the Data Security and Privacy Policy published on the website of PassNave Ltd.

 

A passenger who

 

  • does not have a valid ticket,
  • has not purchased a ticket for the correct journey, or
  • makes unauthorised use of a travel discount,

 

In the case of an invalid ticket, the amount of the on-the-spot surcharge is three times the full fare per person.

If the ticket is for an incorrect journey, the difference must be paid, plus a surcharge of three times the difference.

Once the journey has started, the return ticket cannot be refunded.

If the passenger's point of embarkation or destination cannot be determined, he/she will be charged the fare and surcharge applicable to the entire journey from the point of embarkation to the destination or from the point of embarkation to the point of disembarkation.

In the event of a breach of the conditions of travel, the PassNave Ltd. ticket inspector shall immediately upon becoming aware of the breach record the circumstances of the case. The PassNave Ltd. ticket inspector is entitled to prohibit the berthing of the vessel or its passage for a short period of time in order to carry out an effective inspection.

Passengers who are required to pay a surcharge must provide proof of identity and address to the inspector. In the event of refusal to provide such proof, the inspector may request police action to obtain the information or exclude the passenger from the journey.

Payment of the fare and surcharge as stated in the report may be made in cash at the ticket offices in the ports operated by PassNave Kft. or by bank transfer to the account number of PassNave Kft. indicated in the report. In the case of bank transfer, payment is deemed to have been effected when the amount of the fare and surcharge is credited to the bank account of PassNave Kft.

If the obligor fails to pay the fare and the surcharge as stipulated in the protocol within 8 days from the date of travel, PassNave Kft. will request the obligor to fulfil his/her obligation by setting a new deadline. If the passenger fails to meet the obligation by the new deadline, PassNave Kft. will take legal action to recover the claim. The costs of the latter shall also be borne by the debtor.

In the case of a journey with an invalid ticket, the full fare plus three times the full fare as a surcharge will be payable. In the case of a ticket for an inappropriate journey or an unauthorised use of a travel discount, the difference between the full fare ticket and the ticket purchased shall be payable, plus three times the amount of the difference as a surcharge.

 

17. ) Responsibility

 

PassNave Kft. is liable for damages arising during the passenger transport relationship in accordance with the provisions of these Terms and Conditions. The provisions of the Civil Code of Civil Procedure applicable to companies shall apply. The liability of PassNave Ltd. for damages shall be limited to 150% of the fare or contractor's fee paid.

If the passenger transport is affected or prevented by force majeure circumstances, whether or not specified in these Terms and Conditions, PassNave Kft. shall not be liable for cancellation of the flight for such reasons, or for defective performance of the passenger transport contract, but shall refund the fare paid within 30 days.

PassNave Ltd. shall not be liable for fragile or perishable goods in the luggage of passengers or for damage caused by them, or for damage resulting from improper packaging.

 

18) Rules for reporting and handling complaints

 

The passenger must report any complaint or report arising from the passenger transport relationship (hereinafter referred to as "complaint") without delay, but no later than 48 hours after the circumstances giving rise to the complaint arise, in order to enable PassNave Kft. to take the necessary measures to remedy the situation and to fully clarify the facts on which the claim is based. This deadline is expressly time-barred. The passenger is liable for any damage resulting from the delay in notification.

10.10.10. 10.10. 10.10. omplaints will be investigated immediately by Passnave Kft and rectified as necessary. If the consumer does not agree with the handling of the complaint or if it is not possible to investigate the complaint immediately, the company must immediately take a record of the complaint and its position on it and send a copy to Passnaveave.com.

 

(a) in the case of an oral complaint made in person, to the consumer on the spot,

(b) in the case of an oral complaint made by telephone or other electronic communications service, to the consumer at the latest at the same time as the reply on the substance.

 

PassNave Ltd. shall otherwise act in accordance with the rules applicable to written complaints.

 

Written complaint

Complaints may be submitted in writing in the following ways, accompanied by a copy of the ticket and all other supporting documents:

 

  • by post to the PassNave Kft. complaints office at 1056 Budapest, Belgrade quay, International Boat Station
  • by e-mail to ertekesites@mahartpassnave.hucímre
  • by writing in the buyers' book at the boat stations
  • filling in the report form on board the vessel

PassNave Ltd. will provide a reasoned reply to complaints made by telephone or in writing within 30 days. Verbal complaints communicated by telephone or electronic communication service must be given a unique identification number by PassNave Kft. PassNave Kft. will inform the passenger of the legal remedies available to him/her in the reply letter at the end of the complaint handling procedure, as well as the contact details of the consumer protection authority and the conciliation body.

 

If the passenger's complaint is rejected, he or she may appeal to a conciliation body. The conciliation body is an independent body attached to the county (metropolitan) chambers of commerce and industry. The conciliation body of the passenger's place of residence or stay is competent for the procedure. To initiate the conciliation body's procedure, the passenger must attempt to settle the dispute directly with the undertaking concerned. The passenger may start the procedure by submitting a written request to the chairman of the conciliation body. The conciliation body shall be competent to settle consumer disputes out of court.

Following the abolition of the National Consumer Protection Authority, the first instance consumer protection authority will be established in 197 districts, so that from 1 January 2017, passengers can address their complaints primarily to the district offices responsible for the area.

 

19.) Customer service

 

MAHART PassNave Ltd. operates a telephone customer service, the contact details and current opening hours of which are published on its website. Outside office hours, it is possible to contact the company in writing. The company will reply to any correspondence sent within 2 working days (except in the case of complaint handling, where point 18 applies).

 

20) Subcontractor

PassNave Ltd. is entitled to use a subcontracted carrier. If PassNave Ltd. subcontracts the performance of the passenger transport services it undertakes to another contractor, the terms and conditions of these Terms and Conditions and the individual contract shall apply.

 

21) No Licensing

The rights arising from the passenger transport contract may not be assigned to a third party without prior written notice to PassNave Kft.

 

22) Statute of limitations

All claims against PassNave Kft arising from the passenger transport contract shall, unless a shorter period is stipulated in these Terms and Conditions, expire after 6 months at the latest.

 

23) Law and Disputes

Hungarian law shall apply to the settlement of any disputes.

 

For the settlement of any dispute arising out of or in connection with any agreement, contract concluded under these Terms and Conditions, or in connection with the breach, termination or validity or interpretation thereof, the parties submit to the decision of the competent court of the place where the Company is established.

 

The terms and conditions of the individual contract concluded with the customer or passenger shall prevail over these Terms and Conditions.

 

24) Publication of these Terms of Business

PassNave Ltd. publishes the current Terms and Conditions in full on its website (www.mahartpassnave.hu), where they can be downloaded free of charge. PassNave Ltd. shall make the Terms and Conditions available for inspection at ticket offices and boat stations during opening hours.

 

The Rules and Regulations published on the website are the text in force, as amended.

 

Amendments:

 

The last amendment is valid until 30 June 2023.
